The state of California recognizes five types of homicide:

As you can see, homicide does not necessarily equate to murder.  Murder charges apply when there was some form of premeditation.  First degree murder is applicable where the killer specifically planned and intended to kill with extreme malice.  Second degree murder is where there was planning involved, but not with such malicious intent as in the case of murder in the first degree.

Voluntary manslaughter is when the death was as a result of triggered emotion, such as fear or rage.  Involuntary manslaughter is an accidental death, such as those that result from drunk driving accidents. Lawful killing is the justified killing by a police officer or other law enforcement official.

The state of California treats murder convictions with much severity.  A conviction could result in life in prison or even the death penalty if a judge deems it appropriate. The Oakland criminal attorney’s goal in every murder case is to minimize the sentence of every client, or possibly get the case dismissed if there is not sufficient evidence to prove that a client committed the crime.
